Constitution

Bear & Wolf Advokatanpartsselskab is a Danish private limited company registered under the business registration (CVR) number 41868406.

Regulatory Authority

The attorneys-at-law working at Bear & Wolf Advokatanpartsselskab have been admitted to practice law by the Danish Ministry of Justice and are members of the Danish Bar and Law Society. 

Simon Tracey is a Registered European Lawyer appointed by the Department of Civil Affairs in Denmark (Civilstyrelsen), and he too is registered with the Danish Bar and Law Society

The attorneys-at-law working at Bear & Wolf Advokatanpartsselskab, and Simon Tracey, are subject to the supervisory and disciplinary system of the Danish Bar and Law Society and the rules of professional conduct set out in section 126 of the Danish Administration of Justice Act. In addition, the code of ethics for lawyers applies, see the website of the Danish Bar and Law Society (available in Danish only). 

We would like to specifically draw your attention to the fact that our associated firm in the UK – Bear & Wolf (UK) LLP – provides advice on UK law. Bear & Wolf (UK) LLP does not advise on Danish law, and its work is therefore not covered by the rules and regulations of the Danish Bar and Law Society (Advokatsamfundet) that apply to Bear & Wolf Advokatanpartsselskab in Denmark; neither is Bear & Wolf (UK) LLP, or any advice it gives or services it provides, subject to the supervision of the Danish Bar and Law Society. Furthermore, as Bear & Wolf (UK) LLP does not undertake reserved legal services on behalf of clients (such as the conduct of litigation in England and Wales), it is not regulated by the UK equivalents of the Danish Bar and Law Society and Simon Tracey does not provide any services for Bear & Wolf (UK) LLP in his capacity as a barrister or as a registered foreign lawyer. 

Conflict of Interest

In accordance with the rules of the Danish Bar and Law Society and our internal rules, we assess whether there is a conflict of interest or loyalty, before taking on a client and/or a matter. 

Bear & Wolf Advokatanpartsselskab also collaborates with others, primarily Bear & Wolf (UK) LLP and FPS PartG mbB, on the provision of assistance as per agreement with the client and on request provides information about the measures taken to avoid any conflicts of interest in that respect.

Insurance

Bear & Wolf Advokatanpartsselskab has taken out third-party liability insurance with the Danish registered branch of CNA Insurance Company (Europe) S.A. (CVR 40015604), Hammerensgade 6, 1267 København. All attorneys-at-law, and Simon Tracey, are covered by the company’s liability insurance and guarantee scheme. The third-party liability insurance covers all legal services performed by Bear & Wolf Advokatanpartsselskab regardless of place.

General Terms of Business and Choice of Law and Venue

Any dispute relating to our legal services will be resolved in accordance with our general terms of business, which are included within the Engagement Letters that are concluded with our clients, prior to us rendering our advice.   

In accordance with our general terms of business, any dispute concerning the legal services of Bear & Wolf Advokatanpartsselskab are governed by Danish law, and the Danish courts have sole jurisdiction over the same, the City Court of Copenhagen being the court of first instance. However, Bear & Wolf Advokatanpartsselskab may demand that such disputes be decided by an arbitration tribunal in accordance with the Rules of Arbitration Procedure of the Danish Institute of Arbitration. 

Complaints about Fees and Conduct

Our fees are based on the individual matter and the following criteria: The value or significance of the matter to the client, the scope and complexity of the work performed, the outcome of the matter, the time spent, including whether work was required to be performed outside normal working hours, and the responsibility associated with the matter.

If our clients consider that Bear & Wolf Advokatanpartsselskab’s legal services have been unsatisfactory, we encourage them to contact the partner responsible for their matter to find a solution in the first instance. 

If our clients are still dissatisfied with Bear & Wolf Advokatanpartsselskab’s legal services, our clients may contact Simon Tracey at any time. 

If the dispute is not amicably resolved, any dispute concerning the conduct and/or the fees charged by a an attorney-at-law of Bear & Wolf Advokatanpartsselskab can be resolved by filing a complaint at Advokatnævnet, Kronprinsessegade 28, 1306 København K, www.advokatnaevnet.dk
